Should Huntington Village Residents Have Open Access To Their Own Association's Books and Records?

In September 1997, several Huntington Village residents questioned annual assessment increases that began in 1984 by the Board without the required mandatory vote of  the community. 


There have been request upon request made for access to the HVCA  Books and Records. These documents are, according to our Published  Deed Restrictions, to be freely accessible by any member of the Association,  ( View Section 35 of Your Deed Restrictions  )   but so far little, if any, information has been made openly available.  We now know that the required mandatory vote of the community in order to validate any increase in our annual assessment beyond $96 has never taken place.  


In order to increase our annual assessment  beyond the maximum limit  published in section #23 of our Deed Restrictions, a minimum of 90% of the community property owners would be required to have voted yes. Today that required minimum is a 75% affirmative vote.  There is now admission that the mandatory vote that was required in order to increase our annual assessment never took place. The President of the HV Board of Directors recently responded to the Texas Attorney General's Office regarding this very topic. In this written response, he finally had to admit in print that "...no documents exist to legitimize the increase...", yet you are still being billed 50% over the maximum published limit. How can this happen?

FACTOID:  HVCA is required by it's own Deed Restrictions and Bylaws to provide access to the Association Books and Records according to section 35, during reasonable business hours upon request, or may be liable for damages of up to $200 per day.
